Welcome to Kilo-$ Messenger Ltd. wholly owned and operated by Kilo-$ Messenger Ltd. (‘Kilo-$’, ‘Kilo-$ App’, ‘Company’, ‘we’, ‘us’ , ‘our’). Please carefully read this Privacy Policy  (‘Policy’) and if for any reason you do not agree to any and all of the stipulations contained within the Policy, please do not continue to use our products and services. 

 

Kilo-$ recognizes how important privacy is to each and every individual and we are fully dedicated to providing the highest level of privacy protection to everyone who visits and uses our product/s and service/s. Kilo-$ takes firm, proactive steps to protect your personal information and privacy and by visiting and/or using our sites and/or product/s and service/s you give us consent to the collection, storage, processing, usage, sharing and disclosing of your personal information as described in this Policy. Kilo-$ is providing this Policy to describe and demonstrate our commitment to privacy by explaining the types of information we collect, store, process, use, share and disclose that personal information from individuals who visit or use our official website (‘Site’) www.kilo-s.com and/all other websites of Kilo-$ its subsidiaries with authorised links to this Policy including but not limited to any third party sites, products and services and visit or use or purchase product/s or service/s in our Kilo-$ App (‘App’) product.

 

Kilo-$ has established links to this Policy to make it visible and simple to locate.

 

As an important starting point, Kilo-$ will never use personally identifiable information except as detailed in this Policy. Further, by visiting and/or using our products and services you consent to the policies, practices and terms of the this Policy as amended from time to time and as incorporated in our standard Terms of Use and Terms and Conditions, visit www.kilo-s.com .

Kilo-$ reserves the right to modify, change, update and/or alter the terms of this Policy at any point in time and you agree to adhere to any and all such changes as they are publicly posted on our official Site. Any  updates or changes to this Policy we will notify you through a push notification or email by giving 30 calendar days notice.  Please also revisit this Policy from time to time to ensure that you are aware of any updates, changes or amendments. Your continued use of Kilo-$ App, Site, products and services constitutes your agreement to this Policy and any amendments.

 

 

 

Collection of Information

 

User Information Directly Provided to Us

 

We will only collect personally identifiable information about you that you provide voluntarily via the Kilo-$ App or Site and/or other commonly accepted means of communications, including but not limited to sms, notifications, email and phone. The range of information may vary, depending on how a visitor and/or user utilizes the App or Site. The scope of personal information the App and/or Site may initially gather that you provide voluntarily to open a Kilo-$ account includes:

 

• Your name

   We require you enter your correct first name.

 

• Your surname

   We require you enter your correct name.

 

• Your unique username

We require you to enter your correct unique username that you would like to be known as.

 

• Your profile photo and status text (optional)

Kilo-$ provides an optional feature to upload a profile photo and/or enter a status text.. Obviously if you do not upload a profile photo, no photo will be displayed (there will just be our standard silhouette image) and if you do not enter any text in the status section, no text will be displayed.

 

• Your mobile number and country dialing code

We require you enter your counrty dialing code via the drop down menu and then enter your correct mobile number. A SMS will be sent to your mobile phone to verify your mobile number.

 

• Your promoters mobile number and country dialing code (optional)

Make sure you enter ‘Kilo-$ Promoter’ (edit later) as your Promoter (the person who invited you to use Kilo-$ App)  if you do not have your Promoters mobile number at hand when you are registering as once a Promoters mobile number has been entered it can not be changed.

Promote-A-Friend means you can Promote a Friend by inviting them to download and use Kilo-$ App through a <link>. When they register and place your mobile number as their Promoter they will be connected to your inner circle contacts (friends) in our Kilo-$ Promote-A-Friend rewards program.

Preminum App version - Promote Friend (48 hr reserved) means you have 48 hrs reserve to invite your friends to register you as their Promoter provided they have not registered before you or they have not registered with someone else as their promoter.

If your friends (contacts) have opened a Kilo-$ App account proceeding your registration date you obviously can not invite them to join you in our Promote-A-Friend rewards program, however any one of them may invite you.

The system will allow you to register a Promoter at a later date so long as the Promoter has a Kilo-$ App registered date preceeding your registered date or you have not entered a Promoter before hand. All you need to do is go to the slide menu and tap View Profile and scroll down to your Promoters details and edit. Please note, once a Promoter has been allocated to a user it can not unfortunately be changed.

You may edit or update your profile page at anytime. The more details you provide the better your security and the more rewards you may benefit from.

 

• Your contact list (phone book/ address book) and media (photos, videos, audio)

Kilo-$ App has a ‘contact list matching’ feature that populates your contact (friends) list.  In order to provide this feature Kilo-$ will periodically access your contact list (phone book and address book) to locate other Kilo-$ App users and visa versa and then notify each user who they may know. There is also an optional feature for users to request your permission to chat or not. We may need to have access to your gallery or photos so that you can send media chats.

 

• Other contact lists (phone books/address book)

If other Kilo-$ users permit us to collect information from their contact list (phone book/address book) and you are one of those contacts, we may merge any information from that user’s contact list (phone book) with other information we may have collected about you.

For additional features, functionalities, benefits and rewards and/or products and services we may require additional information about you such as:

 

• Your location

We may require to collect your device location information in order to activate and use our location based features and functionalities.

 

• Your gender

We may require to collect information about your gender.

 

• Your date of birth or age

We may require to collect information about your date of birth or age.

 

• Your email address

We may require to collect information about your email address and name.

 

• Your debit or credit card number

We may require proof of card (sometimes a photo of the card) or any other associated information.

 

We may also request from time to time to verify information via sms or email.

We may also collect other user information directly provided to us from time to time via the following events:

 

• messages and media content

If you communicate with one or more other Kilo-$ user/s we will keep possession of each sender’s and receiver’s transaction data, however not the text associated with each Kilo-$ unique username and message. With regards to media content such as photos, video and audio etc. (and group chats)  sent and received between users, we may keep this content for a longer time period before it is deleted from our system. Please see opt –out and deletion section.

 

• posting and broadcasting

If you post or broadcast messages through our broadcasting threads , any information contained in your post or broadcast will be stored on our system and any user will be able to view it.

 

• products and services purchases

If you purchase any products or services from us , we will collect all the necessary information in order to complete the transaction, including, your name, shipping address (never a P.O. Box), billing address, email, mobile number, phone number and credit or debit card details.

 

• survey and specific promotional participation

Users may voluntarily submit personal information when they participate in a special promotion, register to receive specific promotional announcements and/or request to be involved in a variety of different promotional events and/or activities.  This information can be used in a variety of ways, including but not limited to:

- Welcoming you when you visit the App and/or Site

- Informing you of facts relating to your access and use of the App and/or Site

- Updating you about special offers from Kilo-$ and/or third party Advertisers   whose names and advertising banners may appear on our App and/or Site

If you participate in one or more of Kilo-$ surveys or special , we may collect additional information about you.

If you contact us through email (support@kilo-s.com), we may collect your name and email address and any other information included or volunteered in the email.

 

• third parties

If you opt to invite others (third party) to create a Kilo-$ account either through our 48 hour reserve via paid sms feature or any other feature, you should only

do so if you know that they would want to be be contacted. By using the Kilo-$ SMS service, you have authority or permission from the recipient that may be required by law to send them text communication. By no means will messages be deemed as coming from Kilo-$ as you will have full ability to edit any text messages...

• Device Information

Kilo-$ is all about communicating and sharing with friends and colleagues and therefore we may collect information from your contact list (phone book/address book) and media such as photos, videos and audios. We do this to enhance the functionality of our products and services and for any other purpose as described in this Policy, including but not limited to the collection of information about your device such as mobile number, mobile network and status, operating system and version, device type, browser type and language preference or other apps on your device for performance and diagnostic purposes. It may also include what sites, pages and products you viewed and used and how long you spent on each, links clicked and other activities.

 

• Groups (Private and Public)

Kilo-$ App enables you to send and receive messages and other content to more than one user by adding the user/s to your conversation/s and each user will then receive subsequent messages and content from any user in the group with time and date stamps. There is an option for users to acept invitations to the group automatically or manually.

 

• Location Information

We may collect your device location information in order to activate and use our location based features, functionalities and services and for any other purpose as described in this Policy.

 

• Activity Information

We collect information about the activity that the sender and recipients message through our services, including but not limited to, date, time and the most exchanged and interactive messages sent and received and the mobile number the messages were sent from and to.

 

• Content Information

The content we may collect, including but not limited to all forms of media, how long we keep it, or how long third parties may have access to it, may vary subject to the section that covers ‘deletion’ in general.

 

• Cookies Information

Cookies are small bits of information that are sent to your device when you view our Site/s to uniquely identify your web browser. We use both transcient (or session cookies) and persistent cookies. Transcient cookies are temporary as they are not retained after the user closes a web browser. Persistent cookies (permanent or stored cookies) are stored until they expire or are deleted by the user. We use persistent cookies to collect identifying information about our users,  such as web surfing behaviour or user preferences to provide a more interactive, personal and useful experience on our Site. Most web browsers are set to accept cookies by default. If you refuse or disable cookies our services may not operate satisfactorily.

Web beacons are tiny its of software on a webpage or email that enable us to identify how a user may interact with that webpage or email.

 

• Third Party Information

Third party service providers may collect information about you, your mobile device or computer automatically and such information may be associated with your mobile number, unique username, email address and device information. Please note that you use all third party sites, products and services at your own risk. We may also receive personally identifiable information about you via third party companies and combine this with any other information we may have collected about you.

When you use our Site, we collect certain log file information including but not limited to,  visiting our Site, identifying the websites you visit, pages viewed,  your web browser type, language, access times, your  IP (Internet Protocol) Address, domain names, number of clicks, status information and other associated actvities  as described in this Policy.

 

• Web Browser feature

A web browser or browser for short is a software application used to locate, retrieve and display content on the World Wide Web, including web pages, images, video, audio and other files. The browser is the software run on a device that contacts the webserver and requests information and then sends the information back to the browser which displays the results on any Internet-enabled device that supports a browser.  When you use the Kilo-$ web browser feature we may collect the web addresses of the websites you visit. Most web browsers are set to accept cookies by default, however you usually have the option to set your browser to reject or remove browser cookies. If you refuse or disable cookies our services may not operate satisfactorily.

 

• Analytics and Advertising Aggregator Information

Kilo-$ may share data with advertising aggregators and analytics providers such as Google Analytics and other third parties on an anonymous basis to analyze promotional advertisements (‘Promos’), websites, products and services used by our users to enhance the accuracy of targeted audiences on our and/or  third party websites, products or platforms. Additionally, we may use the data that you voluntarily provide and/or that we request to: notify you of special offers and/or promotions that may be of direct interest to you.  We may also use your information for marketing research and/or share your information with business Affiliates and  Advertisers to provide informative material that you may request or have expressed an interest in.

 

• Search Engine functionality

When you use the Kilo-$ search engine feature we may collect and retain the information accessed.

 

• Other sources

If other Kilo-$ users permit us to collect information from their contact lists (phone books / address books) and you are listed as one of their contacts, we may combine that information with the information we have already collected about you. We may also gather information about you from other sources and combine that with the information we already have about you.

 

 

Use, Share and Disclosure of Information

 

How we Use, Share and Disclose Information

 

• General

We collect, store, retain, use, share and disclose information to operate, maintain and provide functionalities, features, benefits and rewards of the Kilo-$ App, Site, products and services such as identifying and verifying you as a user, creating an account, administering our voluntary Promo rewards, Promote-A-Friend rewards and support a cause programs, communicate with you and your friends through emails, push notifications, newsletters, surveys, special offers and Promos to target and match user profiles and interests through user preferences and trends and any other purpose for which the information was collected as described in this Policy.  

 

In short, the information we collect is used to bring users a complete set of prodcuts, services and functionalities to suit their needs that we continuously strive to develop, improve and refine.

                      

• Profile

Your profile information will be viewed by other uses including analytics data such as the number of messages you have sent and received, who you exchanged messages with the most, depending on your settings and choices. Some or all of your profile information will appear on lists of others depending on your settings and choices  and you give full consent to using, sharing and disclosing this information as described in this Policy. We rely fully upon you to acquire whatever consent that is necessary from the users you may invite to use Kilo-$ Messenger as required by law to permit this collection, use, sharing and disclose of information.

 

• Contact List (phone book/address book)

When you  give us consent to access your device contact list (phone book/ address book) and media we may share information about you with other uses who have your mobile phone number in their contact list (phone book/ address book).

 

• Messages and Media Content

When users send and receive messages they will see each others unique username and the message whether it be text or media such as photos, videos or audio. You can block or delete specific uses through variuos settings.

 

• Status Information

Every Kilo-$ user who have mobile numbers in their contact list (phone book/ address book) that are Kilo-$ users will be able to see each contacts’ Status information and if other users  have your mobile number stored in their contact list (phone book/ address book)  they will be able to see your Status information unless you have blocked them. Last seen

 

• Last Seen Information

Last seen information can be viewed by each user who has your mobile phone number in their contact list (phone book/ address book) and displays the last time the Kilo-$ App was used. There is also text displayed next to your contacts profile reflecting ‘typing’ if they are typing and ‘I’m online’ as a defaultif they are not typing.

 

• Promoter Status Information

There are three Promoter Status icons (‘K’) as a Kilo-$ user and only one will be applicable for your qualification type. The Status applicable to your App version and activity will be displayed next to your profile silhouette picture if you have not uploaded a profile photo or next to your profile photo if you have uploaded one. Every Kilo-$ user who have mobile numbers in their contact list (phone book/ address book) that are Kilo-$ users themselves will be able to see each contacts Promoter Status icon and if other users have your mobile number stored in their contact list (phone book/ address book)  they will be able to see your Promoter Status icon unless you have blocked them.

 

• Third Party Companies, Websites and Advertisers

We may use third party organizations to assist us with regards to our business operations such as analytics, technology, research, payment processing, advertising, and client service. Your personal information is limited to the necessary functionality that each service provider performs  on our behalf. If you download an App or click on any other website from a third party your personal information may be disclosed to that third party. Kilo-$ makes no representation and is not responsible for the availability of, or content located on or through, these third party sites. A third party link from our App or Site is not an indication that Kilo-$ endorses the third party or its site, or has any affiliation with or between Kilo-$ and the third party hosting site. You use all third party websites at your own risk. We only have non-intrusive Promo Advertisements supplied by third party agregators as we believe there is great benefit for all if it is controlled through an optional click environment.

 

• Jurisdiction

Although Kilo-$ is based in the United Kingdom we welcome Kilo-$ users from all over the world and through your continued use of our products and services you expressly consent to the processing and transfering and consent of personal information collection and use in and to the United Kingdom and other countries not withstanding where you live in the world or where you use our prodcuts or services. Although the laws of the United Kingdom and those of other countries where your information is processed may not be as protective as the laws where you live. Your information may also be available to governments or their agencies and law enforcement requests and enquiries irrespective of the safeguards we have put in place for the protection of privacy of this Policy. 

 

We may also share and disclose your personal information and you hereby authorise us to do so without your consent if we have good reason to believe that by doing so its consistent with, or required by any applicable law, or it would be deemed necessary to co-operate with any legal process, investigation or action against someone who may potentially violate our user policies and terms or be involved in causing harm, serious injury or loss of security, interfering either directly or indirectly with our, our users or anyone elses rights, safety and property.

 

• Children

We are totally committed to protecting the privacy of children and therefore we do not direct our products and services to anyone under the age of 13 years and we do not knowingly collect or maintain personally identifiable information or non-personally-identifiable information from children under the age of 13. All teenagers between the ages of 13 and 18 years need to obtain permission from their parents or legal guardian before they can use our products or services.

 

Children under the age of 13 years are prohibited from using our products or services. If this comes to your attention please make sure your under age children deactivate their accounts or if they are between the ages 13 and 18 years please make sure that they are permitted to do so. If it comes to our attention that personally identifiable information or non-personally-identifiable information of children under the age of 13 years or teenagers between the ages of 13 and 18 years has been collected on the App, Site or other products or services we will deactivated the account.

 

• Sale, Merger or Insolvency

We may share and disclose your personal information (we have collected and have consent over) in the event that Kilo-$ Messenger is in negotiations with another entity with regards to any merger, sale of all or a portion of company assets, or acquisition of all or a portion of company stock.

 

We also reserve the right to transfer or assign your personal information as part of such sale, merger, acquisition or change in control, provided the information acquired continues to be utilized as described in this Policy. However, in the unlikely event of an insolvency, bankruptcy or receivership, your personal information may also be transferred as an asset and we may not be able to control or protect how it is used.

 

• Security

We collect, store, maintain, use, share and disclose your personally identifiable information using procedures to perserve the integrity and security of your personal information. Security is important to us, however we can not fully ensure or warrant the security risks levels of your personal information or any other information you may transmit to Kilo-$ and therefore you do so at your own risk. We will attempt to notify you of any security breach.

 

 

• Opt–Out and Deletion

Our services are programmed to delete messages and media from our systems once you and the recipient have received the message and or media after a certain time which may vary from time to time especially where groups are involved and therfore we can not guarantee that messages will be deleted within a specific time.

You may opt-out of any correspondence including but not limted to newsletters, push notifications, emails, surveys, offers and other marketing researches and promotions by following the unsubsribe instructions or by contacting us directly at support@kilo-s.com

You may request Kilo-$ to delete your personal information, however we may be required by law or otherwise to keep some or all of this information for a certain time period and then proceed with the deletion request once such requirements have been met or fulfilled. Any information deleted will be removed from our interactive database, however it will remain in our archives or storgae back up indefinitely.
